Inspection of the crime scene in pre-trial proceedings is carried out by the police and the investigating judge in instances where direct observation is necessary for establishing or clarifying a fact material to criminal proceedings. If the investigating judge does not immediately arrive to the site concerned, the police may inspect the site on their own and order the necessary expert examination, with the exception of autopsy and exhumation. If the investigating judge arrives to the site while these acts are in progress, he or she may take over and perform such acts by himself or herself. The police and/or the investigating judge must notify the state prosecutor of the these acts without delay.
During the investigation, the investigating judge is responsible for conducting the inspection, and in the phase of the main hearing, the inspection can be carried out at the hearing or outside of the main hearing. The inspection can also be done at a hearing before the High Court.
