A summon should be directly sent by the foreign authority to the person to be heard by post as registered mail. Summon may only be sent via the competent Hungarian authority as a service of process, if: a) the address of the person for whom the document is intended is unknown; or b) it has not been possible to serve the document by post; or c) there are justified reasons for considering that dispatch by post will be ineffective or is inappropriate; d) the person has been kept in custody. In the frame of MLA, summons on a person staying in Hungary will only be served, if the summon is transmitted to the competent Hungarian authority at least 40 days before the date set for appearance.
The summon should be accompanied by a Hungarian translation or a translation into the native language of the person to be summoned or into a language he understands.
When summoning a minor, an adult person providing care for the summoned minor shall be notified and requested to ensure that the minor appears. If the minor has not attained the age of fourteen years, he shall be summoned or notified through an adult person providing care for him. The summon and notification to a minor shall also be communicated to his statutory representative.
