Legal Framework

Among Member States having implemented the EIO: Art. 31 Directive 2014/41/EU (implemented by the Law of 1st August 2018).

Competent Authority

As a matter of principle: the Investigating Judge, under the conditions set forth under article 88-1 to 88-4 of the Code of Criminal Procedure. The EIO shall be addressed to the General State Prosecutor.

Where Luxembourg acts as the ‘notified Member State’, notification shall be made by using the form set out in Annex C of the EIO Directive. Luxembourg authorities may notify, at the latest within 96 hours after the receipt of the notification, that the interception may not be carried out or shall be terminated where the interception would not be authorised in a similar domestic case.
