Is this measure possible in your Member State under International Judicial Cooperation?

Yes. Joint investigation teams between national and foreign police agents, set up in a cross-border crime context, in order to carry out difficult investigations requiring important means in several Member States, and demanding for a coordinated and concerted action in such Member States. Measure with a precise objective and limited in time, with the possibility of prolungation. Scope: in practice: criminal offences with any of the above mentioned criteria. Alternative measures: Assistance from the authorities requesting that a rogatory letter is carried out.

International legal framework applicable for this measure in your Member State

Convention of 29th May 2000 on Mutual Assistance in Criminal Matters between the Member States of the European Union (art. 13), and its Protocol of 16th october 2001, approved by statute of 27th October 2010 - Council Framework Decision of 13th June 2002 on joint investigation teams, transposed by statute of 27th October 2010.

The general prosecutor, the prosecutor, the investigating magistrate, according to the conditions set forth by the statute of 27th October 2010 on joint investigation teams.

Concise legal practical information

Special requirements

To be requested by international letters rogatory. Contents: - an indication of the authority making the request; - the object of and the reason for the request; - time and place of perpetration of the offence, a summary of the facts, and the link between the facts and the measure requested ; - where possible, the identity and the nationality of the person concerned; - an indication of the criminal conduct under investigation and the sanctions incurred; - any proposals concerning the prospective members of the JIT team. Formalisation of the measure in a written agreement between the judicial authorities of the concerned Member States. Execution of the measure in conformity with the procedure applicable in the requesting State : no; operations performed on Luxembourgish territory must be carried out in respect of Luxembourg law. Assistance or participation of agents of the requesting State in the execution of the measure, under the conditions set forth by the statute of 27th October 2010 on joint investigation teams
