International legal framework applicable for this measure in your Member State

Regulation (EU) 2018/1805 of the European Parliament and of the Council of 14 November 2018 on the mutual recognition of freezing orders and confiscation orders; Council Framework Decision 2003/577/JHA of 22 July 2003 on the execution in the European Union of orders freezing property or evidence; the MLA 1959 Convention with its additional Protocols; the MLA 2000 Convention and the 2001 Protocol.

Competent Authority

Circuit Prosecutor´s Office (Prokuratura Okręgowa) having territorial jurisdiction– for the pre-trial stage; District Court (Sąd Rejonowy) having territorial jurisdiction – for the trial stage; National Prosecutor’s Office Bureau of International Cooperation – is a central authority for the pre-trial stage. Poland did not establish a central authority for cases at the judicial stage of the proceedings. However, if a freezing order was issued at the judicial stage of the proceedings, and establishing the competent court in Poland was not possible (even via contact points of the European Judicial Network), the transmission of an order will be possible via the Ministry of Justice Department of International Cooperation and Human Rights.

Special requirements

Regulation 1805/2018 - in accordance with Article 4(2), the Polish authorities will accept original freezing orders or certified copies thereof together with freezing certificates translated into Polish; - in accordance with Article 6(3), the Polish authorities will accept freezing certificates translated into Polish; - in accordance with Article 14(2), the Polish authorities will accept confiscation certificates with a view to the recognition and execution of a confiscation order or certified copies thereof together with freezing certificates translated into Polish; - in accordance with Article 17(3), the Polish authorities will accept confiscation certificates translated into Polish.
