International legal framework applicable for this measure in your Member State

Regulation (EU) 2018/1805 of the European Parliament and of the Council of 14 November 2018 on the mutual recognition of freezing orders and confiscation orders; the MLA 1959 Convention with its Additional Protocols; the MLA 2000 Convention with the 2001 Protocol.

Competent Authority

* receive the request/decision for judicial cooperation

District Court (Sąd Rejonowy) having territorial jurisdiction. Poland did not establish a central authority for the confiscation cases. However, when establishing the competent court in Poland was not possible (even via contact points of the European Judicial Network), the transmission of an order will be possible via the Ministry of Justice Department of International Cooperation and Human Rights.

Polish. MLA – Polish, but English and French are also acceptable.

Deadlines provided for in the Regulation 1805/2018; no deadlines for the MLA requests.
